1. Definitions

In these Terms and Conditions, the following words shall have the following meanings:

” glass replacement service” means the glass fitting/repair service provided by us;

” glass products ” means any glass products supplied in connection with the glass replacement service;

” you ” means the customer receiving the glass replacement service;

” us “, ” we ” or ” our ” means Splendid Window Glass Repairs Pty Ltd.

2. Application of Terms and Conditions

These Terms and Conditions shall apply to the glass replacement service and glass products provided by us. By ordering the glass replacement service, you agree to be bound by these Terms and Conditions.

3. Provision of glass replacement service

3.1 We will provide the glass replacement service with reasonable skill and care.

3.2 The glass products we supply will be of satisfactory quality (According to NSW trade practices act 1974).

4. Your obligations

4.1 In order to receive the glass replacement service, you must:

(a) provide us with any glass products or other materials that we need to carry out the glass replacement service; and

(b) ensure that the premises on which the glass replacement service is to be carried out are safe and free from obstruction.

4.2 You must comply with all reasonable instructions issued by us from time to time in relation to the glass replacement service.

5. Our right to cancel the glass replacement service

5.1 We may cancel the glass replacement service at any time before we start providing the service if:

(a) you breach any of your obligations under these Terms and Conditions; or

(b) we reasonably believe that it is not safe or practical to provide the glass replacement service.

6. Liability

6.1 We will be liable to you for any loss or damage that you suffer as a result of our breach of these Terms and Conditions, provided that such loss or damage is reasonably foreseeable.

6.2 We will not be liable to you for any loss or damage that you suffer as a result of your breach of these Terms and Conditions.

6.3 Nothing in these Terms and Conditions shall exclude or limit our liability for:

(a) death or personal injury caused by our negligence; or

(b) fraud or fraudulent misrepresentation.

7. Statutory rights

7.1 These Terms and Conditions shall not affect your statutory rights as a consumer.

8. General

8.1 We may modify these Terms and Conditions at any time without notice to you.

8.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.
